§ 138-31. Restrictions.

    Bathing shall be permitted at those beaches only when they are protected by lifeguards and, prior to May 15 every year, City Council, by way of resolution approved by the Mayor, shall designate those areas of beach, as herein before defined, which shall be subject to protection by the North Wildwood Beach Patrol. Nothing in this section shall be deemed to require the North Wildwood Beach Patrol to provide protection to an area of beach that has been designated by resolution to be subject to protection if, in the opinion of the Chief of the North Wildwood Beach Patrol, ocean or other conditions would make use of said area of beach hazardous. Nothing in this section shall be deemed to authorize the North Wildwood Beach Patrol to provide protection to an area of beach that has not been designated by resolution to be subject to protection.
    B. 
    Swimming at the designated public beaches at any time other than when said beaches are protected by lifeguards is prohibited, and swimming at any other beaches within the City of North Wildwood is likewise prohibited.
