Between the hours of sunrise and sunset, as those hours are established
by the U.S. Naval Observatory, Astronomical Applications Department (aa.usno.navy.mil)
for the City of North Wildwood, it shall be lawful for an individual to operate
an electric personal assistive mobility device on the streets, bike paths
and boardwalk that are located within the confines of the City of North Wildwood
except that, between May 1 and October 1 it shall be unlawful for an individual
to operate an electric personal assistive mobility device on the boardwalk
and, at all times, it shall be unlawful for an individual to operate an electric
personal assistive mobility device on the county highways and state highways
that are located within the confines of the City of North Wildwood. In addition
to the helmet provisions that are set forth in N.J.S.A 39:4-14.10, an operator
of an electric personal assistive mobility device shall wear a reflective
vest. Nothing in this section shall be deemed as prohibiting a law enforcement
officer from operating an electric personal assistive mobility device within
the City of North Wildwood during the regular course of that officer's
law enforcement duties.
