The stripping of topsoil and the excavation of clay, sand, gravel,
rock or other such material shall be permitted and the material thus
excavated may be sold only under the following conditions and in conformance
with the requirements of this chapter:
(1)
As part of the construction of a building or the construction or
alteration of a street.
(2)
The surface of the lot shall not be graded to a level below that
of adjoining properties.
(3)
Stripped and excavated materials are not required for the final grade
and landscaping of the property.
(4)
Stripped and excavated materials are changed or renewed in compliance
with the provisions of this chapter and/or any condition of subdivision
or site plan approval.
