§ 240-7. Non-life-hazard uses; condominium units located within life-hazard uses.

  • A. 
    In addition to the registration required by the Uniform Fire Code, the following non-life-hazard uses shall register with the Bureau of Fire Prevention. These uses shall be inspected once per year and shall pay an annual fee as set forth below:

    (1) 
    Retail stores.
    (a) 
    Less than 2,000 square feet: $75.
    (b) 
    Two thousand one square feet to 3,000 square feet: $85.
    (c) 
    Three thousand one square feet to 4,000 square feet: $90.
    (d) 
    Four thousand one square feet to 6,000 square feet: $135.
    (e) 
    Six thousand one square feet to 8,000 square feet: $165.
    (f) 
    Eight thousand one square feet to 10,500 square feet: $210.
    (g) 
    Ten thousand five hundred one square feet to 11,500 square feet: $270.
    (h) 
    Eleven thousand five hundred one square feet to 12,000 square feet: $285.
    (i) 
    Greater than 12,000 square feet: $285 + $15 per each 1,000 square feet or portion thereof.
    (2) 
    Eating and drinking establishments and assembly uses with occupancy under 50 persons: $100.
    (3) 
    Dwelling units.
    (a) 
    One- and two- and three-family nonowner-occupied (occupied for any portion of year by persons other than the owner): $40.
    (b) 
    Four to seven units: $125.
    (c) 
    More than seven units: $175.
    (4) 
    Hotels and motels not classified as life hazards.
    (a) 
    Up to six units: $125.
    (b) 
    Seven to 11 units: $150.
    (c) 
    Twelve to 30 units: $225.
    (d) 
    More than 30 units: $295.
    B. 
    Two-family non-owner-occupied uses shall be inspected and charged a fee only upon sale or change of tenant.
    C. 
    Uses not classified above that are subject to the Uniform Fire Code will be classified as retail stores.
    D. 
    Uses required to register with the state as life-hazard uses shall not be required to register under this section.
    E. 
    In the discretion of the Fire Official, vacant buildings will be charged and inspected according to the previous use of the building.
    F. 
    All residential uses except one- and two-family non-owner-occupied uses shall be inspected in the common areas only.
    G. 
    Any person or legal entity owning a condominium (as “condominium” is defined in the New Jersey Condominium Act, N.J.S.A. 46:8B-1 et seq., as amended from time to time) that is located within the confines of a life-hazard use shall register the condominium with the Bureau of Fire Prevention. Such condominium shall be inspected once per year and shall pay an annual inspection fee of $35. This subsection shall apply to all condominiums located within life-hazard uses without regard to whether the owners thereof use the condominiums for residential purposes, commercial purposes or otherwise. The date of inspection shall coincide with the date on which the life-hazard use within which the condominiums are located is to be inspected. Written notice of the date of the scheduled inspection shall be provided to the owners, as they appear on the property tax records of the City of North Wildwood, of condominiums subject to inspection. Such notice shall be mailed, by regular, first-class mail, to such owners as their addresses appear on the property tax records of the City of North Wildwood. Entry into condominiums for the purposes of conducting inspections pursuant to this subsection shall be subject to the provisions of N.J.A.C. 5:70-2.1, as amended from time to time.
