§ 33-4. Definitions.

A. 

As used in this chapter, the following terms shall have the meanings indicated:

AGENCY

Any agency, board, governing body, including the Chief Executive Officer, office, commission or other instrumentality within the City of North Wildwood, and any independent local authority created by or appointed under the authority of the City of North Wildwood, which performs functions other than of a purely advisory nature.

BUSINESS ORGANIZATION

Any corporation, partnership, firm, enterprise, franchise, association, trust, sole proprietorship, union or other legal entity.

EMPLOYEE

Any person, whether compensated or not, whether part-time or full-time, employed by or serving on an agency who is not a local government officer.

INTEREST

The ownership or control of more than 10% of the profits, assets or stock of a business organization but shall not include the control of assets in a nonunion profit entity or labor union.

MEMBER OF IMMEDIATE FAMILY

A spouse or dependent child of an officer or employee residing in the same household.

OFFICER

Any person, whether compensated or not, whether part-time or full-time, who is one of the following:

(1) 

A member of City Council.

(2) 

Mayor.

(3) 

City Administrator.

(4) 

Chief Financial Officer.

(5) 

Public Works Superintendent.

(6) 

Construction Official.

(7) 

Director of the Department of Recreation.

(8) 

Chief of Police.

(9) 

Deputy Chief of Police.

(10) 

Captain, Police Department.

(11) 

Tax Assessor.

(12) 

Tax Collector.

(13) 

City Clerk.

(14) 

City Solicitor.

(15) 

City Engineer.

(16) 

City Auditor.

(17) 

Municipal Judge.

(18) 

City Prosecutor.

(19) 

City Public Defender.

(20) 

Planning Board member.

(21) 

Planning Board Attorney.

(22) 

Zoning Board of Adjustment member.

(23) 

Zoning Board of Adjustment Attorney.

(24) 

Fire Chief.

(25) 

Deputy Fire Chief.

(26) 

Assessment Commissioners.

(27) 

Members of the Tourist Development Commission.

(28) 

Members of the Lighthouse Commission.

(29) 

A member of the City of North Wildwood Ethical Standards Board.

(30) 

Any other person who is a managerial executive or confidential employee, as defined in Section 3 of the New Jersey Employer-Employee Act, N.J.S.A. 34:13A-3, of the City of North Wildwood or any agency created under the authority of or appointed by the City of North Wildwood.

OFFICER or EMPLOYEE

An officer or employee of the City of North Wildwood or of an agency under the authority of or appointed by the City of North Wildwood.
